Terms and conditions of Accidental Damage Insurance for Starlink

IMPORTANT
This Cover offered by Starlink is arranged with Seib Insurance and Reinsurance Company LLC (a national insurer, hereinafter referred to as Seib, licensed by Qatar Financial Centre Regulatory Authority, the insurance Regulator). The Cover is administered through MAPFRE Assistance (the ‘Administrator’) which is the sole authorized agency for the purposes of the benefits afforded by the Cover.

General Definitions & Conditions

 

OBJECT AND SCOPE OF INSURANCE
Accidental Damage
Subject to sections 3, 4, 5 and 6 below, the Insurer shall bear the costs of repairing or replacing the Insured Good, in case Accidental Damage as a result of the following sudden causes:

ROBBERY AND BURGLARY
Subject to section 3, 4, 5 and 6 below, and in case of Robbery or Burglary the Insurer shall bear the costs of replacing the Insured Good. The insurer has the right of providing the insured with a refurbished device when having the option.

ECONOMIC LIMIT

The covers set out in section 2 are limited to:

SPECIFIC EXCLUSIONS

In addition to the General Exclusions to all the cover sections of this policy, this cover shall not be provided for the following cases and their consequences:

GENERAL EXCLUSIONS

On a general basis for all the guarantees and benefits under the present General Conditions, the consequences of the following are excluded from any guarantee object of this contract:

LIABILITY CONDITIONS

In the event of any claim, the liability of the insurer shall be conditional on the Customer claiming benefit having complied with and continuing to comply with the terms of this Policy.
The Insured shall keep original invoice and insurance certificate, containing the device’s IMEI, to avail the Accidental Damage, Robbery and Burglary benefit.
In the event of an Accidental damage, robbery or burglary covered under this policy, the insured person shall:

FRAUDULENT CLAIM:

If the Insured Person makes a claim knowing the claim to be false or fraudulently exaggerated in any respect or make a statement in support of a claim knowing the statement to be false in any respect or submit a document in support of a claim knowing the document to be forged or false in any respect or make a claim in respect of any Accidental Damage caused by the Insured Person willful act or with the intent to defraud the Insurer and Assistance Company, Then the claim will be declined and your insurance certificate will be cancelled without notice with no refund of premium. The Insurer and Assistance Company may be entitled to recover from Insured Person the cost of any claim already paid under this Insurance Certificate (if necessary, the cost may be recovered through the instigation of court proceedings). Insurer and Assistance Company may also be entitled to recover from Insured Person the cost of any investigation into a fraudulent claim under this Insurance Certificate (if necessary, the cost may be recovered through the instigation of court proceedings).

INSURANCE CERTIFICATE TERMINATION:

In case the Assistance Company or Insurer discovers that the Insured Person is not eligible for the insurance coverage due to not meeting the criteria of the insurance conditions listed in Section 5, the Assistance Company or Insurer reserves its right to terminate the policy immediately and refund the full premium to the Insured Person. Such a condition shall be applied up to a maximum period of twenty-two days (22) from the certificate issuance date. For the avoidance of doubt, should the Insured Person claim the benefit of the certificate during the above mentioned twenty-two days (22) period, Assistance Company or Insurer shall not be allowed to prevent the Insured Person from benefiting of the coverage under the Insurance Certificate.

REPLACEMENT OF DEVICE BY MANUFACTURER WARRANTY PROVIDER

In the event insured device is replaced by manufacturer warranty provider due to manufacture fault and insured needs to update his/her certificate data, insured shall provide official proof from manufacturer warranty provider which shows that the replacement of device and such a proof shall contain the details of both devices such IMEI / serial number, brand and model of the devices. Such request shall be reported to the administrator company within a maximum period of 96 hours from the date of device replacement otherwise the administrator company reserves its right to reject the request.

CLAIMS

The Insured Person, or [Company] on his behalf, must contact the Assistance Company by tel. on 44320918 or by email on TECHDEP@mapfre.com within a maximum period of 3 working days from the date of the Accidental Damage. The Insured Person or [Company] on his behalf then is required to submit the required documents or device to the [Company] service centre designated by Assistance Company within a maximum of 10 working days from the date of notification of the claim to the Assistance Company’s Claim Department.

No claim will be undertaken by the Assistance Company unless notified in accordance with the terms of this section.

10.1 CLAIM DECLARATION FORM:

When the Insured Person declares a claim, the claim declaration form shall be filled out, signed and submitted to the claims Administrator Company by the insured,

The Assistance Company will arrange the repair the covered breakdowns or damages in a Gulf Assist’s authorized repair facility, under these Terms and Conditions and in accordance with the Insured Person, who is required to allow access to the Insured goods or their transfer where necessary.

Protecting Your personal data

Seib and company may use the information supplied during the formation and performance of this Cover for administration, customer services, repairs, paying claims and fraud prevention.
We may disclose this information to Our Service Providers for these purposes and will keep this information for a reasonable period.
Where sensitive personal data has been disclosed, we will also use this information for the above purposes only.
Individuals whose information has been supplied to us have a right to ask for a copy of that information and to have any inaccuracies corrected. We may record telephone calls to make sure it follows instructions correctly and for staff training purposes.
When personal or sensitive data is supplied to us about third parties other than You, We assume that those third parties consent to the supply of this information to us and to the transfer of their information for the purposes of this Cover to other persons or parties within or outside the State of Qatar. We will also assume that You, the supplier of the information, is authorized to receive, on their behalf, any data protection notices.
It is however Your responsibility to ensure that You have backed up all data including personal data from Your Equipment before handing it over to us.

Client Disclosure

It is your responsibility to provide complete and accurate information to insurers when you take out an insurance policy, throughout the life of the policy and when you renew your insurance. It is important that you ensure all statements you make on proposal forms, claim forms and other incidental documents are full and accurate.
If you fail to pass on any documents or information required, act dishonestly or outside the terms of the contract or agreement, we may cancel your policy, declare the contract to be void and refuse to pay any claim under the policy. It is in your own interest to disclose all facts to us. If you are in any doubt whether certain facts are important or mandate disclosure, please contact us and our team will be pleased to assist you free of charge.
Premium payment is due upon receipt of your policy documents and invoice except where otherwise specified in the policy with a Premium Payment Warranty (“PPW”) clause.
In case you fail to pay your premium within the agreed-upon timelines, we may cancel the policy, refuse to honor any claim, and require you to repay any arrears due or the balance of any monies yet to be paid.

Money Laundering

Money laundering regulations may require us to obtain proof of identity and to verify the company name, owners, authorized signatories, address, source of funding and other ancillary details before we can arrange transactions on your behalf. By submitting an application, you authorize us to undertake any additional scrutiny for the purposes of verifying your identity. A record of such scrutiny will be retained. In certain circumstances you may be required to provide further evidence of your identity and address in which case we will contact you for additional information.

SANCTION CLAUSE

Seib and (Company Name xxxxx) shall not be deemed to provide cover and shall not be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose (Company Name xxxxx) to any sanction, prohibition or restriction under United Nations resolutions, Qatar’s NCTC National Terrorist Designation List or the trade or economic sanctions, laws or regulations of the European Union, United Kingdom or United States of America.

For complaints

The Beneficiary shall refer the Complaint to: 

Starlink Call Centre if the complaint relates to the repair service that the Beneficiary received or relates to the scope of coverage.

If the Beneficiary is not satisfied with the response from Starlink, He/she may refer the complaint to Seib.
All Parties shall ensure that complaints are handled in a timely and appropriate manner.

Seib considers customer satisfaction as a major part of its mission. Your Legal Rights

Please note that your acceptance of these terms of business in no way affect your normal legal rights.

DECLARATION AND CONSENT

By confirming receipt or signing these Terms of Business, you consent on the above Terms of Business and hereby authorize the transfer of information between such third parties, as described above, on a confidential basis when warranted. You agree that the Terms of Business will come into effect once received or signed and returned.

Governing Law

This Cover is governed by the laws of the State of Qatar. The courts of Qatar shall have exclusive jurisdiction to settle any dispute which may arise in connection with this Cover.
